Sexual Assault of a Child, Article 120b, UCMJ; Lewd Act Upon a Child, Article 120b, UCMJ – A staff sergeant was charged with sexual assault, sending lewd photos, and sending lewd communications to a child. The Staff Sergeant was found guilty of sending lewd communications by a panel at a General Courts-Martial and was sentenced to fifteen months confinement, reduction to the grade of E-1, a dishonorable discharge, and total forfeiture of pay and allowances.

Nonjudicial Punishment
Dereliction of Duty, Article 92, UCMJ/Assault Consummated by a Battery, Article 128, UCMJ - A Technical Sergeant made inappropriate comments to a Senior Airman that were sexual in nature and amounted to creating an intimidating and hostile work environment, as defined by DAFI 36-2710, Equal Opportunity Program. Additionally, the Technical Sergeant grabbed the zipper of the same Senior Airman’s top coat, which amounted to assault consummated by a battery. The member accepted an Article 15 as a forum and received the following punishment: reduction to the grade of Staff Sergeant, restriction to Tinker AFB for five days, forty-days extra duty, and a reprimand.

Child Pornography, Article 134, UCMJ – A Technical Sergeant possessed multiple images of child pornography on his personal computer and in his personal email. The Technical Sergeant was found guilty by a General Court-Martial and sentenced to eighteen months’ confinement, a dishonorable discharge, reduction to the grade of E-1, and total forfeiture of all pay and allowances.

Result of Courts-Martial
Sexual Assault, Article 120, UCMJ – A Senior Airman sexually assaulted a civilian by committing a penetrative sexual act without the victim’s consent. Additionally, the same Senior Airman assaulted the civilian by strangling them, wrongfully engaged in extramarital conduct with another member who was not their spouse, wrongfully used marijuana, and attempted to wrongfully use cocaine. The Senior Airman was found guilty by a General Court-Martial and sentenced to three years’ confinement, a dishonorable discharge, reduction to the grade of E-1, and total forfeiture of all pay and allowances.

Nonjudicial Punishment
A Lieutenant Colonel unlawfully placed their arm around a junior member, whispered in the junior member’s ear, made sexual comments towards the junior member, and kissed them on the head without their consent. Additionally, the Lieutenant Colonel unlawfully struck another member. The Lieutenant Colonel accepted an Article 15 and received punishment of forfeitures of $5,272 per month for two months (the portion of the forfeitures in excess of $5,272 pay per month for one month was suspended) and a reprimand.

Sexual Harassment, Article 134, UCMJ – A Master Sergeant committed sexual harassment by making sexually-charged comments towards a co-worker. The Master Sergeant also created a hostile work environment and participated in an unprofessional relationship. The Master Sergeant accepted an Article 15 and received punishment of reduction to the grade of E-6 (suspended for six months), forfeiture of $2,308.00 per month for one month, and a reprimand.

Administrative Action
Sexual Harassment, Article 134, UCMJ – A Captain committed sexual harassment by making multiple sexual jokes and gestures towards another officer, which created a hostile work environment. The Captain received a reprimand.

Sexual Harassment, Article 134, UCMJ – A First Lieutenant committed sexual harassment by making multiple sexual jokes towards another officer, which created a hostile work environment. The First Lieutenant received a reprimand.

Administrative Discharge
UOTHC Discharge, Misconduct – A Senior Airman took photographs of a woman’s private areas without her consent and solicited prostitution on multiple occasions. The Senior Airman received an under other than honorable conditions (UOTHC) discharge.

UOTHC Discharge, Misconduct – A Senior Airman committed abusive sexual contact by touching two men’s private areas without their consent and touched a third man without his consent. The Senior Airman requested to be discharged in lieu of court-martial and was discharged with an under other than honorable conditions (UOTHC) discharge.
